According to reports, the lawsuit has been given the go ahead by a US federal judge. This means Apple and its exclusive carrier of iPhone 4 are going to face another trouble after a spate of issues, ranging from iPhone 4’s antenna issues to AT&T’s dismal services. If the Apple-AT&T exclusivity deal ends, it would clear the way for much awaited Verizon iPhone too. So does that mean the reports of Verizon iPhone 4 coming in January 2011 are going to be proved true? Wait and watch. Reports reveal that Apple’s move to grant ‘exclusive’ contract to AT&T, allowing the carrier to host iPhone 4 for five years has been highlighted in the complaint, which dates back to 2007 when the first legal action was taken. Several identical lawsuits against the ‘exclusive’ clause have been placed together into a single class action. Judge James Ware of the US District Court for the Northern District of California announced that parts of the lawsuit that highlighted the antitrust law breaches were tantamount to a class action. The judge, however, rejected other claims that Apple had breached laws when an update to the Iphone’s OS hung handsets and deleted apps programs that the users had purchased. The Associated Press reports that the iPhone 4 maker has sold over 50 million units of iPhones in the space of three years. The lawsuit, the AP further reports, alleges that Apple secretly made AT&T its exclusive Iphone partner for five year. It’s notable that consumers have to sign a two-year contracts with AT&T, thus the tenure of the deal increases to six years. The class action has held respondent to anyone who purchased iPhone with the infamous two-year agreement with AT&T. In case Apple loses the case, it will not be allowed to sell iPhones with ‘exclusive’ hosts in the country. And top of that it may have to pay hefty legal fees and other costs. That's like saying Motorola cant keep the Motorola Droid exclusive to there network. T-Mobile cant keep the MyTouch 3G exclusive.
